Delhi Apartment Ownership Rules 1987
Delhi Development Authority has published a Public Notice regarding functioning of RWA:-
Apartment owners of multi storied buildings of Delhi are hereby informed that as per the provisions of Delhi Apartment Ownership Act, 1986, the owners of the multi storied buildings are required to form an Apartment Owner’s Association in terms of Exhibit “B” of Delhi Apartment Ownership Rules, 1987 read with Section 15(2) of Delhi Apartment Ownership Act, 1986.
The Apartment Owners Association subsequently shall take over the management of common areas and facilities from the Promoter / Builder. All the books of account, bank account and other documents with respect to the management of common area and facilities shall be handed over by the Promoter / Builder to the Apartment Owners Association, so formed and all functions relating to the management of the building, common areas, collection of maintenance charges, expenditure to be incurred on maintenance, employment of manpower, legal compliances, etc. will be performed by the Association (as per the orders of the Hon’ble Delhi High Court dated 28.05.2010)
All the apartment owners are further informed that the promoters / builders /developers are required to execute the deed of apartment (as per mandate of order dated 28.05.2010 read with order dated 13/07/2010 in WP(C) No.1959/2007 titled as O.S. Bajpai Versus Administrator (L.G.) and others) as well as per the provisions of the Delhi Apartment Ownership Act, 1986. In case, any promoter / builder / developer fails to execute the deed of apartment, the apartment owner may apply to the concerned Nodal Officer for execution deed of apartment in accordance with the law as per prescribed format.
