Defect or deficiency in a Consumer Dispute

(e) “consumer dispute” means a dispute where the person against whom a complaint has been made, denies or disputes the allegations contained in the complaint;

(f) “defect” means any fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard which is required to be maintained by or under any law for the time being in force or 2[under any contract, express or implied or] as is claimed by the trader in any manner whatsoever in relation to any goods;

(g) “deficiency” means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which is required to be maintained by or under any law for the time being in force or has been undertaken to be performed by a person in pursuance of a contract or otherwise in relation to any service;

Whereas the Consumer is any person who buys any goods for consideration which has been paid or promised or partly paid and partly promised or under any system of deferred payment and includes any user of goods other than the person who buys such goods for consideration paid or promised or partly paid or partly promised or under any system of deferred payment when such use is made with the approval of such person but does not include a person who obtains such goods for resale or for any commercial purpose.

The Consumer is only that person who purchases the goods for his own use and not for commercial purpose.

    Be aware of quatar. Quatar has a new way of cheating nd fraud. Qutar will issue your ticket nd done over booking after dat they will not allow u 4r boarding even,

    If ur passport n visa is proper they tell u dat ur documents r nt proper n don’t done your boarding den u will miss ur flight n den ur plan for going for tour or any work dat will fail nd then dey will nt give u full refund for ur ticket nly 45% is given rest 55% is nt given,,,

    7nz5pm is my pnr no dis happnd with me and my family (I bought ticket from travel agent it’s around 1,70,000 rs=2550 us dollar) , i ws travelling frm delhi to paris on 7/6/2016 at 1.45am,

    Even after all our documents were correct qutar boarding counter did not allowed us for the flight nd tld us ur documents r not proper i set hole night at airport den on 7/6/2016 at 1:30pm i went 4rm air india frm delhi to paris on same documents which the qutar did nt allowed,
    nw quater is giving me 45%refund rest 55% refund dey r nt giving even after all the documents were correct ,,

    Deear sir Now how I get my refund please tell me ,,,

    IF IN A CGHS 30 YEAR OLD , A FLAT IS UNOCCUPIED FOR ALMOST TEN YEARS AND NO REPAIRS OR MAINTENNANCE IS DONE BY FLAT OWNER . THE FLAT IS IN A DILAPADATED CONDITION POSING RISK TO UPPER FLAT OWNERS. WHAT CAN BE DONE IF A MC IS NOT WORKING AND THE MEMBER DOES NOT RESPOND TO RWA LETTERS REGARDING THE DILAPADATED CONDITION.

    Myself Anusha, from Bangalore.

    First, I request you to read my complete case for better understanding.

    I bought an electric two wheeler. This vehicle started giving problems within two weeks of purchase. It suddenly stops moving. I call up the dealer, he comes & repairs but asks for service fee which i did not give them argued with them as it still under warranty period.

    Now this repeats for five times and sixth time when it happened, i retured the vehicle back to the dealer as requested to refund the money.

    My argument is for once or twice we can repair the vehicle. I am not saying that the dealer defaulted on service but each time they repaired the vehicle, i had to argue with them that i cannot pay the charges as it was under warranty period. In this condition, how can i use the vehicle if it frequently giving problems and that too within warranty period?

    Whenever the vehicle ceased to move, i was stranded on the city roads far away from my workplace & my home with no access for workshops (as it is an electric vehicle) and had to always depend on the dealer’s technician. Sixth time when it stopped, the dealer did not agree to come to the spot as it was nearly 20 kms away from their office. I had to arrange for a medium sized truck at odd hours of 8pm in the evening and had to shell out Rs.2000 to bring the vehicle to dealers showroom. Thats the last i told i will not take back the vehicle as it is frequently giving problems.

    My question is who is at fault, the dealer or manufacturer? I gave cheque in dealer’s name. Now the vehicle is with the dealer. On whom should I file the complaint in the consumer forum? The dealer is saying they have rectified/repaired the vehicle and asking me to take back. But what if the same problem arises again?

    Kindly advice. With two years of continuous savings from my salary i arranged for the down payment. Now i have lost both money & vehicle.

    I was purchased a printer machine from a shop last month, after that they are delivered the machine within 2 days but in that point they were not gives me a warranty card and now the machine is not working how can I deal with him now. Please help me sir…
