Compliance under Contract Labour R & A (i) Registration of the Establishment

 

  • Form No. 1 in Triplicate to Registering Officer (Regional/Asst. Labour Commissioner of the Region) with Demand Draft for the necessary fee:

Note– In case of change in particulars like change in no. of workmen engaged, nature of contract, change of contractor etc. specified in Certificate of Registration, such changes have to be intimated to the Registering Officer within 30 days of such change. No need to renew the Certificate of Registration if there are no changes in the particulars.

 

  • Form VIII (for Temporary Registration)  in Triplicate to Registering Officer (Regional/Asst. Labour Commissioner of the Region) with Demand Draft for the necessary fee in case the employment of Contract Labour is not likely to exceed 15 days :

(ii)               Licence for Contractors

 

  • By the Contractor – Form IV in Triplicate to Registering Officer (Regional/Asst. Labour Commissioner of the Region) along with Form V (to be issued by Principal Employer) with Demand Draft for the necessary fee and Security Deposit:

The security deposit @ Rs. 90 per contract workmen engaged. If the Contractor is a Co-operative Society, the amount shall be @ Rs. 15 per contract workmen engaged.

 

  • Licence to be renewed by the Contractor every year within 30 days before the date of expiry by submitting Form No. VII.

 

  • Form X (for Temporary Licence)  to Registering Officer (Regional/Asst. Labour Commissioner of the Region) with Demand Draft for the necessary fee in case  the Contractor is required to engage 20 or more contract labours for not more than 15 days:

(iii)             Register to be Maintained

 

a)      By the Principal Employer

 

Register of Contractors – Form XII

 

b)     By the Contractor

 

1.      Register of persons employed – Form XIII

2.      Muster Roll – Form XVI

3.      Wage Register – Form XVII

4.      Wage-cum-Register (in place of item 2 & 3 if wage period is fortnight or less) – Form XVIII

5.      Wage Slip – Form XIX

6.      Register of deductions – Form XX

7.      Register of fines – Form XXI

8.      Register of Advances – Form XXII

9.      Over Time Register (Recording no. of hours and wages paid for overtime work) – Form XXIII

 

(iv)             Returns

 

a)      By the Principal Employer

 

Annual Returns in Form No. XXV (in duplicate) to the Registering Officer before 15th February of every year.

 

b)     By the Contractor

 

Half Yearly Returns in Form No. XXIV (in duplicate) to the Registering Officer before January 31st and July 31st every year.

 

Note: The Principal Employer has to submit a certificate to the Registering Officer regarding starting/completion of contract work in Form No. VI B within 15 days.

    Whether parking contract lies under the jurisdiction of Contract labour Act and Amendments where only 3 person are working in each parking site.
