A member has purchased a flat and registered in his name under freehold property. He too has applied for a membership which is under consideration. Before granting his membership, he has unauthorisely / illegally extended his balcony. MC is now refused to grant the membership, since he has involved himself in illegal construction. Can MC refused to give membership or pressurise him to first demolish the unauthorised construction then only his membership will be considered.

Dear Sir,
Kindly advise what are the items to be included in the minutes books. However a budget for expenses and capital expenditure has been approved by the General Body. Is it necessary that the expenses need not be recorded in the minutes book by the MC:
1. Expenses relating to either of capital nature or the revenue expenses like repairs of building, computers etc. which has been approved in the budget by the GBM;
2. Where the AMC for lift, Gen set, intercom has been approved by the MC at the time of entering into the contract and the same to be approved as and when the payment is made.
Kindly advise.

Maintenance charges in co-operative housing societies
Dear Sir,
I am a secretary in the one of the Society at East Delhi. Three members have not paid the maintenance charges.
Defaulter No 1. He has rent out the flat as per agreement the tenant is supposed to pay the maintenance charges. but he is not making payment. when ever we approach for the dues, he says the payment will be made by the flat owner. Rent agreement has not been renewed for three years. There is a court case between tenant and the flat owner for vacation of the flat.
Defaulter No 2. The flat is lying vacant and where about of the members is not known.
Defaulter No 3. He has purchased the flat on power of attorney. Sometimes he was regularly paying the maintenance charges but for the past three years he is not making the payment.

MC has proposed that the water connection and the Gen set connection can be disconnect.
The electricity connection is of the flat owner. Can MC also write to the BSES to disconnect the Electricity.

KIndly Advise can we do the above action against the member/ tenant.

One member has approached us to shift the sewer system which was constructed by of his own and join the same in the main sewer of the Society. He wants to get the same repaired at his own cost. Which we would allow. AS regards one of the neem tree which is creating problem and its roots are touching plinth. Our view that we should cut the tree. To whom should we approach to cut the tree on line or offline. Please help.

Society is bound to repair the seepage of flats
what is the responsibility of the MC in connection with the cepage of the inside and outside the flat nad also internal and external cracks develop in the Column.
