Car Parking Charges on Reserved Car Parking Space

 DISPUTE BETWEEN THOSE HAVE RESERVED CAR PARKING AND THOSE WHO DO NOT HAVE

Since the number of parking is very less in most of the Societies in comparison to the number of flats, many of the members who had got chance to take the benefit of even not taking the parking on first come first served basis. The honest and peaceful living persons took the reserved car parking space to keep their future as peaceful living.

Car Parking Charges on Reserved Car Parking Space: Many of the Societies have started charging money from the members for Parking their 2nd Car and 3rd Car or a 4th Car in the Society premises.

We as a public Trust have tried to convince the Society managements that you are intruding into the legal rights of the flat owners and members of the society who are having un-divided interest in the common space and you cannot impose discriminatory car parking charges on them.

But many of the society managements did not agree. Therefore, we declared them that the managing committee personnel are greedy and they are charging zealousy charges from those members who are having reserved car parking space in the Society.

we have filed the case on behalf of the members and we are sure to get back; not only the money illegally collected from the members but also interest and penalty / compensation.

    Our society is charging for parking the cars under the stilt on daily basis. But actually it is not allotted or allocated to any member. The cars of society management are also parked and we think they must not be charging themselves. Please advise what to do ?

    Our society has started charging Rs.100/- on every 2nd car. there is no difference in charges even if we have reserved car space. Why ? Therefore, we have given a name of it as CHEATING CHARGES in our Society. Please advice whether we are right or not

    In my housing society members are more than available parking space (approved plan layout). 300 members and 220 parking lots.
    Flats were sold from the year 2006 till 2013 approx.
    Some members purchased parking lot from builder and the same is mentioned in index II of agreement as allotted and also received parking allotment from builder.
    Some members have not purchased the parking space from builder and for them agreement mentions flat with NIL parking space and also in amenities & common space parking space is not mentioned.

    Society is now giving parking stickers to the allotted members and the vehicles with no stickers will not be allowed to park inside the society.

    Questions:
    1) Can society do this by not allowing the members vehicles who do not have the parking allotment from builder.
    2) As Per supreme court judgment on Panchali Co-operative Society Vs Nahalchand Laloochand Pvt Ltd. Parking space belongs to common space of society and only CHS can do the allotment. Is it correct ?.
    3) As the members are more the available parking space, can society committee cancel the previous allotment and redo the allotment by lot and rotational basis.

    Now the society has identified the additional 30 parking space and allotting to the interested members by charging 15K per annum.
    4) Can society charge only to these 30 members ? every member should have equal rights.
    But society says it is the additional benefit I am taking as the parking space is not mentioned in my agreement and also not mentioned in common space and amenities of my agreement.
    5) Or society should cancel all the allotments done by builder and redo the allotment by lot and rotational basis ?
    If I have some valid points than how to explain these legal points. what is the procedure to send lawyer notice to the soceity. Can I get a format mentioning the acts, bye laws and previous court judgements.
    Where to do such complaints.

    CAN A MEMBER CLAIMS COVERED PARKING AND COMMON PARKING.
    IN OUR SOCIETY 30 PEOPLES HAVE PAID RS.50,000/- FOR COVERED PARKING, THESE 30 MEMBERS HAVE ALSO ALLOTTED ONE CAR PARKING SPACE IN OPEN ALSO. IN THIS CONNECTION PLEASE ADVICE WHAT ACTION CAN BE TAKEN ON MC.

    Dear, I have an open/ uncovered parking allotted to me. If I want to secure a covered parking from another flat owner (Who has his flat on rent) what is the process that I need to follow ? If both parties agree on a price, can we exchange our parking slots, or does the management committee play a role in the same ? please advise how can this be done ? thank you in advance for your advice.

    Dear I have been reading your web-site for the last many days and today I have decided to seek your help. My co-operative society has imposed parkring charges on me for parking 1 two wheeler and 2 maruti swift cars within the reserved and allotted space to me for the last 10 years. I have understood all the rules but need you to fight my case in RCS against this menace. Please tell me how to proceed.
